ANOTHER COMPANY HAS LABELLED AN ISSUE AS 'HEALTH AND SAFETY' BECAUSE THEY DIDN'T WANT TO ACCEPT LIABILITY!
Once again, a company has labelled an issue as 'health and safety' because they didn't want to accept liability! But be reassured, there are no health and safety 'rules' that govern play equipment in gardens. (Bracknell Forest Homes tells mum 'play equipment must go', (8 August 2012 - The Oracle Reading)). To state otherwise is both inaccurate and misleading. Bracknell Forest Homes should have made clear in their statement, that it wanted the play equipment removed for insurance and liability rea...

MOULD, DUST, VAPOURS ETC - ALL YOU NEED TO KNOW ABOUT DISPOSABLE DUST MASKS
When working in agriculture, you can breathe in a range of dusts, vapours, fumes and mould spores or germs that can cause serious lung diseases, such as occupational asthma, farmers’ lung and chronic bronchitis. Severe cases may mean that you have to give up work and face the economic and social consequences. Some industries can achieve this by working with less harmful substances or by containing or removing the hazard. This isn’t always possible in agriculture, so when doing very dusty work su...

HEALTH AND SAFETY SPECIAL CHRISTMAS EDITION
Health & Safety Regulations to be applied during Christmas activities Jingle Bells Dashing through the snow In a one horse open sleigh O'er the fields we go Laughing all the way A risk assessment must be submitted before an open sleigh is considered safe for members of the public to travel on. The risk assessment must also consider whether it is appropriate to use only one horse for such a venture, particularly if passengers are of larger proportions. Please note, permission must be gained from landowners before entering their fields. To avoid offending those not participating in celebrations, we would request that laughter is moderate only and not loud enough to be considered a noise nuisance. While Shepherds Watched While shepherds watched Their flocks by night All seated on the ground The angel of the Lord came down And glory shone around The union of Shepherd's has complained that it breaches health and safety regulations to insist that shepherds watch their flocks without appropriate seating arrangements being provided, therefore benches, stools and orthopaedic chairs are now available. Shepherds have also requested that due to the inclement weather conditions at this time of year that they should watch their flocks via cctv cameras from centrally heated shepherd observation huts. Please note, the angel of the lord is reminded that before shining his / her glory all around she / he must ascertain that all shepherds have been issued with glasses capable of filtering out the harmful effects of UVA, UVB and Glory. The Rocking Song Little Jesus, sweetly sleep, do not stir; We will lend a coat of fur, We will rock you, rock you, rock you, We will rock you, rock you, rock you: Fur is no longer appropriate wear for small infants, both due to risk of allergy to animal fur, and for ethical reasons. Therefore faux fur, a nice cellular blanket or perhaps micro-fleece material should be considered a suitable alternative. Please note, only persons who have been subject to a Criminal Rec...

RISK PROFILING
The risk profile of an organisation informs all aspects of the approach to leading and managing its health and safety risks. Every organisation will have its own risk profile. This is the starting point for determining the greatest health and safety issues for the organisation. In some businesses the risks will be tangible and immediate safety hazards, whereas in other organisations the risks may be health-related and it may be a long time before the illness becomes apparent. A risk profile exam...

AN OVERHAUL OF GUIDANCE ON WORKING AT HEIGHT IS BEING LAUNCHED
An overhaul of guidance on working at height is being launched today (28 January 2014), as part of the government’s long-term economic plan to abolish or improve outdated, burdensome or over-complicated regulations which waste businesses’ time and money.Key changes include: providing simple advice about do’s and don’ts when working at height to ensure people are clear on what the law requires busting some of the persistent myths about health and safety law, such as the banning of ladders w...

PRIMARY SCHOOL NOT ALLOWED LADDERS
Primary school not allowed ladders due to health and safety. Therefore staff use chairs to reach up when 'working at heights'. HSE Panel decision There is nothing in health and safety law that prevents primary schools from using step ladders in classrooms. A properly designed stepstool or stepladder is often going to be the sensible and practical option for carrying out tasks that involve working at height for a short time – and schools are no exception. It’s certainly a safer option than standi...

WORK EXPERIENCE - CUTTING THROUGH THE BUREAUCRACY
Introducing students to the world of work can help them understand the work environment, choose future careers or prepare for employment. It can take the form of a short, or longer, placement with a placement provider (employer) where they will have the opportunity to observe and practice work tasks. But work placement arrangements are too often seen as over-bureaucratic and burdensome, putting off potential employers. We must tackle this and stop over-interpretation of the law. The e...

HSE MYTH BUSTERS CHALLENGE PANEL
Case 328 - Customer not allowed a coffee with a child’s meal deal IssueOn a recent visit to a fast food outlet the enquirer was refused a coffee with a child’s meal deal on health and safety grounds, even though the meal was for his adult self. Panel decision The decision to refuse a hot drink as part of a children’s meal deal package was purely commercial and had nothing to do with health and safety – especially since the customer made clear that the drink was for an adult’s consumption not a c...

CASE 241 - SHOP DOOR LEFT OPEN IN COLD WEATHER
On trying to close a shop door that was left open in cold weather the enquirer was told that the door had to remain open to allow wheelchair users access, apparently this had come from 'Health and Safety'. Panel decision Health & Safety at Work legislation does not require shops to keep their doors open for wheelchair users. The company has confirmed that it has an ‘open doors’ policy, but has made clear that this has nothing to do with health and safety or wheelchair access. It is a business decision. It is not clear whether the shop assistant was aware of the reason for the policy or not, but the company should ensure that the employees understand and do not mislead customers by using health and safety as a catch-all excuse....
